حق بر سلامت کودکان یکی از حقوق اساسی بشر است که در اسناد بین المللی حقوق بشر و حقوق بینالملل بشردوستانه مورد شناسایی و حمایت قرار گرفته است. با وجود این، درگیری های مسلحانه بهطور جدی این حق را نقض کرده و کودکان را، بهعنوان آسیب پذیرترین قشر جامعه، در معرض تهدیدهای گسترده جسمی و روانی قرار داده است. پرسش تحقیق این است که جنگ و درگیری های مسلحانه چه تأثیری بر حق بر سلامت کودکان در غزه داشته و حقوق بینالملل بشردوستانه چه سازوکارهایی را برای حمایت از این حق پیش بینی کرده است؟ تحقیق حاضر با هدف بررسی تأثیر جنگ و خشونتهای مکرر بر سلامت کودکان در غزه انجام شده و میکوشد مهمترین عوامل نقض این حق را شناسایی و سازوکارهای حقوقی و بشردوستانه حمایت از کودکان را تبیین کند. روش تحقیق، توصیفی ـ تحلیلی بوده و بر پایه مطالعه کتاب خانهای، با استفاده از منابع علمی معتبر و اسناد حقوقی بینالمللی، انجام شده است. یافتهها نشان میدهد که حملات نظامی، تخریب زیرساختهای صحی، کمبود دارو و تجهیزات صحی، محدودیت دسترسی به خدمات صحی، سوءتغذیه، کمبود آب آشامیدنی سالم، شیوع امراض واگیردار و آلودگی محیط زیست، سلامت جسمی کودکان را بهشدت تهدید کرده است. افزون بر این، آوارگی، از دست دادن اعضای خانواده، ترس، اضطراب و ناامنی مداوم، آثار عمیقی بر سلامت روانی کودکان برجای گذاشته و زمینه بروز اختلالات روانی و کاهش کیفیت زندگی آنان را فراهم ساخته است. نتایج تحقیق نشان میدهد که حمایت مؤثر از حق بر سلامت کودکان، مستلزم رعایت قواعد حقوق بینالملل بشردوستانه، حفاظت از مراکز صحی، تضمین دسترسی بدون مانع به کمک های بشردوستانه، و تقویت همکاری و نظارت جامعه بینالمللی برای حمایت از کودکان در مناطق جنگ زده است.
Abstract (English)
Children’s right to health is one of the fundamental human rights recognized and protected under international human rights law and international humanitarian law. Nevertheless, armed conflicts have severely undermined this right, exposing children, as the most vulnerable members of society, to extensive physical and psychological harm. Accordingly, this study seeks to answer the following research question: How have war and armed conflicts affected the right to health of children in Gaza, and what mechanisms does international humanitarian law provide for the protection of this right? The study aims to examine the impact of war and recurrent violence on the health of children in Gaza, identify the main factors contributing to the violation of their right to health, and analyze the legal and humanitarian mechanisms available for their protection. The research adopts a descriptive-analytical approach and is based on a review of scholarly literature and relevant international legal instruments. The findings indicate that military attacks, the destruction of healthcare infrastructure, shortages of medicines and medical equipment, restricted access to healthcare services, malnutrition, lack of safe drinking water, the spread of infectious diseases, and environmental pollution have posed serious threats to children's physical health. Furthermore, displacement, the loss of family members, fear, anxiety, and prolonged insecurity have had profound effects on children's mental health, increasing the risk of psychological disorders and significantly reducing their quality of life. The study concludes that effective protection of children's right to health requires strict compliance with the rules of international humanitarian law, the protection of healthcare facilities and medical personnel, the unimpeded delivery of humanitarian assistance, and strengthened international cooperation and monitoring to safeguard children in armed conflict situations.
